What is an Eviction?

An eviction is a legal process in which an apartment community will remove a tenant from a rental property. Often times, it will occur because the tenant has not paid rent or has excessive late pays on rent over a time period. Your lease may outline other reasons that it may occur. If you do not vacate the property after receiving the initial notice, the apartment community may file papers with your local court to proceed with the process. Please note that you should respond to any legal summons even if you have already moved out of the property.

Some examples of why someone would be evicted include:

  • Failure to pay rent
  • Excessive late pays on rent
  • Disturbances or misconduct
  • Damage to property
  • Illegal use of property

How an Eviction Affects Your Credit

The eviction will not directly show up on your credit report, but information related to it will. If the apartment community uses the court to evict you and obtains a judgment against you, the judgment resulting from that eviction will be placed on your credit report. It may also show up on a criminal background check.

Under certain circumstances, an apartment community will work with individuals that have an eviction. Some apartments require that it is at least a certain number of years old, that it be under a certain amount of debt that is due, or that it has been paid off. Please note it is usually up to the apartment management whether they will accept someone with an eviction.
